Tronox Statement: Haley Paint Company Class Action Lawsuit

In April, 2010, a price-fixing class action lawsuit was filed by U.S. paint retailer Haley Paint Co. against five titanium dioxide manufacturers. Tronox is NOT a defendant in this lawsuit. The suit, filed on behalf of all entities that purchased titanium dioxide in the United States after February 1, 2003, alleges a conspiracy to artificially fix and raise prices in violation of the Sherman Antitrust Act. Recent legal notices regarding this litigation have listed Tronox as a seller of titanium dioxide in the U.S. during the period of alleged price fixing. While Tronox did and continues to sell titanium dioxide in the U.S., it was not named as a defendant in the antitrust suit and no damages are being sought from the company.
